TERMS AND CONDITIONS OF SALE AND USE

1. Identification of the seller

2. Acceptance of the Terms
Use of the website and the placement of orders imply that the user has read and accepted these Terms, the Privacy Policy, the Returns and Refunds Policy and the Shipping and Delivery Policy.

Cave Tirsense may update these Terms. The conditions applicable to each order are those in force at the time the order is submitted.

3. Minimum age
The purchase, receipt and consumption of alcoholic beverages are restricted to persons aged 18 or over.

By placing an order, the customer declares that they are legally entitled to purchase alcoholic beverages and undertakes to ensure that the person receiving the order also meets this requirement. Photographic identification may be requested upon delivery. Delivery may be refused where the recipient’s age cannot be confirmed or where the recipient appears to be intoxicated.

4. Products and information
We seek to present product descriptions, images, characteristics, vintages and availability as accurately as possible. Images are for illustrative purposes, and minor differences may exist in presentation, labels, capsules, packaging or vintage, provided that the product is not substantially altered.

Where a specific vintage is essential to the purchasing decision, the customer must confirm it before placing the order or check the specific information provided on the product page.

5. Availability
All orders are subject to stock availability. Adding a product to the shopping cart does not reserve it.

Where a product becomes unavailable after an order has been placed, the customer will be contacted and may choose between a replacement, waiting for the product to be restocked or receiving a refund of the corresponding amount.

6. Prices and taxes
Prices displayed in the consumer Online Shop include VAT at the applicable statutory rate, unless clearly stated otherwise. Delivery costs are shown before the purchase is completed.

In the Professional Area, prices may be displayed excluding VAT and are subject to the commercial terms, minimum quantities, logistical increments and taxes applicable to the customer and the order.

Cave Tirsense may change prices at any time without affecting orders that have already been confirmed, except in the event of a manifest error.

7. Orders and formation of the contract
An order constitutes an offer to purchase. The contract is deemed to have been concluded when Cave Tirsense confirms acceptance of the order or when an equivalent confirmation is issued through the platform.

Cave Tirsense may refuse or cancel an order in the event of unavailability, a manifest error in the price or description, suspected fraud, breach of the applicable conditions, inability to verify the legal age requirement or inability to complete delivery.

Where payment has already been made, the corresponding amount will be refunded.

8. Payment
The available payment methods are presented at checkout. The customer is responsible for providing accurate information and using a valid and authorised payment method.

Orders placed through the Professional Area may be submitted for review and confirmation before payment, in accordance with the conditions assigned to the relevant company and professional location.

9. Delivery
Delivery terms, costs, estimated times and restrictions are set out in the Shipping and Delivery Policy, which forms an integral part of these Terms.

10. Right of withdrawal and returns
Consumers may exercise their right of withdrawal in accordance with the Returns and Refunds Policy and applicable law.

The right of withdrawal does not apply to purchases made by professional customers or companies for purposes connected with their business activity, without prejudice to the agreed commercial terms and any applicable mandatory legislation.

11. Conformity and guarantee
Goods sold to consumers benefit from the statutory guarantee of conformity applicable in Portugal. In the event of a lack of conformity, the consumer is entitled to the legal remedies of bringing the goods into conformity, a price reduction or termination of the contract, subject to the applicable conditions.

12. User responsibilities
The user undertakes to:

  • provide accurate and up-to-date information;
  • protect their account credentials;
  • not use the website for unlawful, fraudulent or abusive purposes;
  • not interfere with the security, operation or integrity of the website;
  • not reproduce or exploit any content without authorisation.

13. Intellectual property
The content of the website, including text, photographs, graphic elements, logos, trademarks, design and code, belongs to Cave Tirsense or is used with the authorisation of the respective rights holders.

Its reproduction, distribution, alteration, publication or commercial exploitation without prior written authorisation is prohibited, except where permitted by law.

14. Third-party links and services
The website may integrate third-party services or links, including payment providers, carriers, social networks and applications. Use of those services may be subject to their respective terms and policies.

15. Limitation of liability
Cave Tirsense shall not be liable for delays or failures resulting from circumstances beyond its reasonable control, including natural events, strikes, transport disruptions, failures of third-party systems or decisions by public authorities.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, nor does it reduce any mandatory consumer rights.

16. Responsible consumption
The information made available on the website does not constitute medical advice. Alcoholic beverages should be consumed responsibly. Alcohol consumption is not recommended during pregnancy, before driving or operating machinery, or where it is incompatible with a medical condition or medication.

18. Alternative dispute resolution
In the event of a consumer dispute, the consumer should first contact Cave Tirsense in an attempt to reach a direct resolution.

Without prejudice to the right to bring proceedings before the courts, the consumer may refer the dispute to the competent Alternative Dispute Resolution entity, including:

19. Governing law
These Terms are governed by Portuguese law. In contracts with consumers, this choice of law does not prejudice the protection granted by any mandatory provisions applicable to the consumer.
